Felony criminal defense: Facing heroin-related drug charges?

Heroin is deemed a controlled substance and is illegal to possess, sell or manufacture in the state of Mississippi. Heroin-related drug charges and their associated penalties vary in their severity. Aside from simple possession and drug paraphernalia, which are misdemeanor offenses, all other heroin-related drug crimes are deemed felony offenses that carry stiff penalties if one is convicted.

Possession of heroin jumps from a misdemeanor offense to a felony offense if one is found to have more than 0.1 grams in his or her possession. The penalties for possession in the amounts of 0.1 grams to 30 grams include incarceration -- anywhere from three to 20 years -- and fines -- up to $500,000. Anyone accused of possessing more than 30 grams of the drug will face trafficking charges rather than possession charges. The penalties for this crime include prison time -- anywhere from 10 years to life -- and fines up to $1 million.

When it comes to selling the drug, how much one is accused of selling is used to determine the penalties if one is convicted. Currently, one may spend up to 30 years in prison and have to pay a fine of up to $500,000. It may be possible to have the sentence suspended if:

  • The defendant is nonviolent
  • The defendant did not use a weapon
  • No one died because of the defendant's actions
  • The defendant played an assistive role rather than being the leader
